  • What a Notary Public?
A Notary Public is an official of integrity appointed by state government —here by the Secretary of State of California— to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. In other words, a Notary Public verifies the identity of the signer of a document, witnesses the signing, and in certain cases, takes the signer's oath and or affirmation that the document they are signing is true to the signer's knowledge. This is to ensure that someone does not sign legal or important documents purporting to be someone else.
  • What do I need to take to have a document notarized?
Valid Form of ID: California Driver License or Commercial Driver License ID Card - Senior Identification Card, Under 18 Identification Card, California Identification Card A US or Foreign Issued passport Beginning January 2017, CA Notaries Public are able to accept Mexican Consular ID Cards as proof of identity. Complete Document(s): A Notary Public cannot notarize any incomplete documents, and cannot offer any legal advice on how to fill out a document. Witnesses: In the event you do not have a valid ID, you will need to bring the witnesses with you. See below.
  • What happens if I do not have a valid for of ID?
If you do not have a valid form of ID, then a Notary Public and notarize a document using twocredible witness: A credible identifying witness is an individual who knows and can verify the identity of a signer. The witnesses appear at the time of the notarization and takes an oath or affirmation before the Notary that the signer is who they claim to be but lacks other forms of ID. The credible witnesses must have their own valid form of ID. Unfortunately, Credible Witnesses cannotbe used to notarize any powerof attorney, quitclaim deed, grant deed, mortgage, deed of trust, security agreement, any instrument affecting real property, or any instrument requiring a notary public to obtain a thumbprint from the partysigning the document in the notary public’s journal.
  • If I am unable to appear before the Notary Public, can someone take my document to be notarized for me?"
Yes! This can be done using a subscribing witness. The proof of execution by subscribing witness certificate is used when a principal signer who cannot appear before the Notary directs a third party (the subscribing witness) to witness that principal’s signing or acknowledging of his or her signature on a document and then to bring the signed document to the Notary for a proof of execution. However, in order to notarize using the subscribing witness, there also must be a "credible witness" who knows both the subscribing witness and the Notary Public. Again, this form of notarization is not allowed on any power of attorney, quitclaim deed, grant deed, mortgage, deed of trust, security agreement, any instrument affecting real property, or any instrument requiring a notary public to obtain a thumbprint from the partysigning the document in the notary public’s journal.
  • Can a Notary Public provide me with the documents I need?
In certain cases, Notaries Public do offer blank forms, but unless the Notary Public also has a license to practice law, then they cannot offer any legal advice or instruction on how to fill out forms. We now offer blank forms for the following: - Parental Permission/Consent for Minor's Travel Outside the U.S. - I-9 Employment Eligibility Verification - Letter of Invitation for Temporary U.S. Visa Purposes - Permission for Parental Action - LA County Certificate of Identity/Sworn Statement for Birth or Marriage Certificate Again, we are unable to offer any advice on how to fill out blank forms. Additional types of forms can be found online by using the links above.
